Holland allegedly "had a concerned look on his face and asked her where she was going" when the woman told him she had to leave, and proceeded to put her underwear in her purse as she left, she told police. When he got up, he allegedly said he was "sorry to disappoint" and that he was done, the court documents said. Holland allegedly responded that he was "pro-condom" and put his hand on her throat during the attack. She told police she threw the condom back at Holland and repeatedly said "she did not want to do this." The woman said Holland removed her dress and pushed her onto his bed, and though she bit at him to try and deter him, he threw a wrapped condom onto her and "it was from this point on that she knew Holland was going to rape her," the court documents said. She told police she told him to stop, sitting up on the couch as he began to grab under her dress, but he "led her to his bedroom while she was stumbling." Holland began asking the woman to "show off" and took off her underwear, the court documents said. Once they arrived at the apartment, Holland allegedly poured the woman a "substantial amount of 'Gentleman Jack' whiskey," but she said she did not feel well and laid on the couch. The alleged victim told police that she met Holland for a date at a local restaurant, had two-and- a-half drinks and agreed to go back to his apartment to have dinner, according to court documents filed by the Twin Falls County Prosecutors Office.
